The Intra-EU/Achmea Jurisdictional Objection: from the Point of View of States and the European Commission
Since the Court of Justice of the European Union rendered the Achmea judgment in March 2018, arbitral tribunals have nevertheless continued to find that they have jurisdiction over intra-EU investment disputes under BITs and the ECT. This webinar will approach the intra-EU objection from the point of view of States and the European Commission, which have not agreed with the positions taken by arbitral tribunals.

In this roundtable, Peter Wolrich of Curtis, Mallet-Prevost, Colt & Mosle LLP who has defended EU States in intra-EU arbitrations, will address the intra-EU objection as a matter of international law. Tim Maxian Rusche of the Legal Service of the European Commission will discuss the avenues that are currently available to States and/or the European Commission to give further effect to their understanding of the intra-EU objection. Ben Steinbrück from Schilling, Zutt & Anschütz Rechtsanwaltsgesellschaft mbH will discuss the implications of recent proceedings before the German courts and avenues that may be available to EU States under German law.
